Q. What is The Ultimate Ballpark Access?
A. The Ultimate Ballpark Access is the new, one stop shop for Nationals Season Plan Holders to manage their tickets, ballpark access and benefits.

Q. How do I log into my account?
A. When you receive your Cards in early March, you will be able to login straight from the nationals.com homepage. Click on The Ultimate Ballpark Access button on the nationals.com homepage and you will be directed straight to the login page. Enter your MLB login and password and you will be directed to verify your first-time user information and accept the terms and conditions. In the first-time user section, it will ask you to enter the Card number and member ID located on the front of your Card.

Q. What happened to My Nationals Tickets?
A. My Nationals Tickets is no longer necessary. Everything needed for a Season Plan Holder to manage their tickets, benefits and access can now be done from their Ultimate Ballpark Access account.

Q. If I share my season plan with partners, how do I get them their tickets if everything is loaded onto my Cards?
A. The Ultimate Ballpark Access allows you to set up partners with their own online accounts and personalized access Cards. Once your partners have activated their online accounts, you can distribute any denomination of your own seats to them. When you distribute a seat to a partner, it will be removed from one of your Cards and is automatically assigned to your partner's Card carrying the same seat location.

Q. If I have more than one seat as a part of my season plan, do I receive more than one Card?
A. Yes. In early March, you will receive your Season Plan Holder package that will include your Cards. For every seat in your plan, you will receive one Card. Each Card will be printed with your name, account number and the seat location.

Q. Do I have to setup partners in order to give my seats to friends, family and clients?
A. The partner feature is meant for our Season Plan Holders who share significant portions of their Season Plans (10 or more games) with other fans. If you are looking to send seats to clients, family or friends for an individual game, emailing those seats via your online account is both faster and easier than setting them up as partners.

Q. What are my options if I can't make it to a game? Do the Nationals still offer exchange and resale opportunities?
A. The Nationals do still support exchange and resale opportunities. If you know what game you won't be able to attend ahead of time, our Future Exchange Program allows you to turn in those seats for seats of equivalent value to another future game. This year, the Unused Exchange Program will give you Red Carpet Rewards Points in return for any unused tickets turned in. Also new for this year, all exchanges will take place online via nationals.com/exchange. Lastly, posting your tickets to StubHub is a few easy clicks away via your online account.

Q. If I purchase additional seats or parking, do those get loaded to my Cards? What about Rewards Tickets?
A. Only the tickets within your Season Plan are loaded to your Cards. All parking passes will be sent in the Season Plan Holder package as colored passes. All other additional tickets, rewards tickets and exchanged tickets will arrive as print-at home emails. You will be able to manage these tickets from your online account.

Q. What if I lose one or more of my Cards?
A. Within your account, there is a REQUEST REPLACEMENT CARD button. There is a $10 fee for lost or stolen Cards. If you lose or forget your Card on your way to the ballpark, please come see us at Ticket Services and we will supply you with a ticket to that game. Once you are inside the ballpark, you can come to the Season Plan Holder Lounge at section 137 to address any Card or online issues.

Q. Can I get commemorative paper tickets for any game?
A. Yes. You can purchase commemorative tickets for any game at the Advanced Ticket Office located inside the ballpark.

Q. Why are there three separate redemption levels for the 2013 RCR Program?
A. In 2013, the RCR Program will feature dynamic point pricing similar to our single game ticket sales. Weekday, weekend and Prime dates all have different price points as shown in the redemption calendar within your account.

Q. What is different about the 2013 redemption opportunities?
A. Within your account, you will be able to bid points on special experiences, autographed items and merchandise using the new auction feature.

Q. Will there be any restrictions to when I can redeem my points?
A. In 2013, our Season Plan Holders will be able to redeem their points as early as 30 days prior to the desired game, and as late as 72 hours prior to that date.

Q: What is Campaign Manager?
A. Campaign Manager is a tool through which we can offer special promotions to our Season Plan Holders. Using your Card you will be able to redeem these promotions at areas throughout the ballpark.

Q: How do I get access to these campaigns?
A. Redemption is as simple as touching your Card at the point of purchase, with notifications coming via email and text message.

Q: What is E-Cash?
A. Coming Soon in 2013: The E-Cash feature allows you to load money to your Card via your online account which can then be used for all of your purchases at Nationals Park. E-Cash provides fast, safe and secure cashless transactions at concessions and retail locations throughout the ballpark.

2013 Ultimate Ballpark Access and Red Carpet Rewards Program

1. General

The 2013 Ultimate Ballpark Access and Red Carpet Rewards Program (“Program” or “2013 Program”) is offered at the discretion of the Washington Nationals Baseball Club (“The Washington Nationals”).  Participation in the Program is subject to these Ultimate Ballpark Access and Red Carpet Rewards Program terms and conditions, rules, regulations, policies and procedures (“Terms and Conditions”).  THIS IS A BINDING AGREEMENT. Your participation in the Program constitutes your consent to these Terms and Conditions. If you do not wish to abide by these rules, do not enroll in the Program.  The Washington Nationals reserves the right to alter or modify the Program at any time in its sole discretion with or without notice, including without limitation, the right to add, modify, cancel, delete or otherwise change any provision of the Terms and Conditions or any procedure, reward, or any benefit of the Program. Members, as defined below, are responsible for remaining knowledgeable as to the Terms and Conditions.   Since any changes will be posted on this page, you should check this page regularly.  Your continued membership in the Program following any changes to these Terms and Conditions constitutes your acceptance of such changes.   

2. Eligibility

The Program is available to Washington Nationals’ season plan holders and suite licensees (collectively, “Season Plan Holders”) who purchase and have either enrolled in the Grand Slam EZ Payment Plan or paid in full for: (i) a “Full Season”, “Half Season” or “Partial Season” plan for the 2013 season (each an “Eligible Participant”).  For the purposes of these Terms and Conditions, “Full Season” plan shall mean any 82 or 81 game plan, “Half Season” plan shall mean any 42 or 41 game plan, and “Partial Season” plan shall mean any 22 or 21 game plan and, in the case of suites only, a “Partial Season” plan shall mean any 27 or 20 game plan.  Other plans may apply.  Contact Ticket Services at (202) 675-NATS for additional information.

Eligible Participants must have enrolled in the Grand Slam EZ Payment Plan or paid in full by July 31, 2013 at 11:59 PM ET. In the event of non-payment or delinquent payment, all rights to participate in the Program shall be forfeited.

3. Participation and Card Activation

Once eligibility is confirmed, Eligible Participants of record will receive a card (“Card”) that will permit access to Nationals Park (“Ballpark”) along with access to Program reward points (“Points”) and Red Carpet Rewards, as defined below.  To participate in the Program, an Eligible Participant must set up an account and enroll online at nationals.com/access (“Program Website” or “Site”) and activate his or her Card.  Activation of the Card signifies your acceptance of the Program Terms and Conditions. 

Card may not be sold, bartered, traded, exchanged, given away or transferred.You are responsible for the loss or theft of your Card, and for any transactions made using the Card. Replacement of a lost or stolen Card may be requested by mail, by email at RedCarpet@Nationals.com or on the “card details” page of the Program Website. There is a $10 replacement charge for lost or stolen cards.

All Eligible Participants must enroll in this 2013 Program to participate, including Eligible Participants who participated in the 2012 Red Carpet Rewards Program. Eligible Participants must also provide a valid email address and telephone number and are responsible for keeping their contact information up-to-date. Eligible participants who enroll in the Program are referred to herein as “Members” and “You”.

4. Online Account

You must register an account at the Program Website to enroll and participate in the Program.  Please follow the on-screen instructions to set up account (“Account”).   Through your Account, you will be able to manage your seats, redeem Red Carpet Rewards, and add E-Cash (as defined below) to your Card.  For your protection and the security of your Account, do not share your login information and password.

5. Ballpark Access and Ticket License Terms

Use your Card to gain access to the Ballpark.  Paper tickets will not be issued.  However, your admission to the Ballpark is subject to the Ticket License Terms stated below. For purposes of this Section 5, all references to “ticket” and “ticketholder”/”holder” shall be read synonymously with “Card” and “Member”, respectively, (as defined in these Terms and Conditions), and your use of the Card to gain admission to the Ballpark constitutes your acceptance of these terms.  

Ticket License Terms

By use of this ticket, the ticketholder agrees that: (a) he or she shall not transmit or aid in transmitting any information about the game or related activities to which it grants admission, including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the game or related activities (the “Game Information”); (b) the Club issuing the ticket is the exclusive owner of all copyrights and other proprietary rights in the game, related activities, and Game information; and (c) the participating Clubs, Major League Baseball Properties, Inc., Major League Baseball Enterprises, Inc., MLB Advanced Media, L.P. and each of their respective affiliates, licensees and agents shall have the perpetual and unrestricted right and license to use his or her name, image, likeness and/or voice in any broadcast, telecast, photograph, video and/or sound recording taken in connection with the game for all purposes and in all media known and unknown throughout the universe.  Breach of any of the above will automatically terminate this license and may result in further legal action.

The license granted by this ticket may also be terminated by tendering to the holder the purchase price of the ticket. This ticket may not be used for commercial or trade purposes (including, but not limited to, contests, promotions or sweepstakes) without the express written consent of the Washington Nationals.  The Washington Nationals reserve the right to change the date and/or start time without notice and without entitling the holder to a refund or exchange.

PROHIBITED ITEMS AND CONDUCT:  Hard coolers, ice chests, backpacks and bags exceeding 16” x 16” x 8”; non-collapsible umbrellas that will not fit in such containers; brooms, poles and staffs; weapons, fireworks and other illegal substances; camera lenses larger than 8”, tripods and monopods; animals (except service animals); beach balls and other inflatable items; laser pens and laser pointers; baseball bats (other than purchased miniatures); metal, plastic or glass containers, excepting clear, factory-sealed plastic water bottles no larger than 1 liter, juice boxes, insulin containers and baby food; food items, excepting those contained in single-serving bags within a soft-sided container or cooler no larger than 16” x 16” x 8”; alcohol not purchased at the ballpark; noisemakers not provided by the Nationals; skateboards; and any other item deemed dangerous, inappropriate, or in violation of the Guest Conduct Policy. The use of foul or abusive language or obscene or threatening gestures, fighting, attempts to enter the field or to cause objects to enter the field, and irresponsible or underage consumption of alcoholic beverages, and any other action deemed dangerous, inappropriate, or in violation of the Guest Conduct Policy may result in the guest being ejected without refund and arrested, or refused initial admission. 

NOTICE:  In the event of rain outs or other circumstances requiring the postponement of the game identified by the game number hereon, please retain possession of this ticket (Rain Check) until the game number hereon has been played.  Should the game numbered hereon not progress to or beyond the point of play constituting a regulation game under the Official Baseball Rule 4.10(c) after the holder has been admitted to the ballpark, this ticket will readmit the holder to the make-up game when scheduled.  This ticket is good only for the particular game and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use the ticket for the assigned game.

WARNING:  The holder assumes all risk, danger and injury incidental to the game of baseball or related activities, whether occurring before, during or after the actual playing of the game, including (but not limited to) the danger of being injured by thrown or batted balls or other objects, or by others in attendance; agrees that Major League Baseball, the participating Clubs, their respective owners, shareholders, partners, agents, players, officers, directors, contractors and employees are not liable for injuries or loss or damage of personal property resulting from such causes; and releases and holds harmless such persons and entities, regardless of whether any injury or loss is caused by any person’s negligence or otherwise.  Batted or thrown balls and bats and other objects can enter spectator areas with great force.  Risk cannot be avoided if you attend games.  If you would like to lessen your risk, the Washington Nationals will exchange your ticket for one in the UPPER DECK OR OTHER REMOTE AREA or, in the event of a sellout, will refund the ticket any time before the first pitch is thrown.

No resale of a ticket is permitted via the Internet or any other interactive media, except through the Official Website of the Washington Nationals (www.nationals.com) or sites authorized by the Washington Nationals.  This ticket must not be resold or offered for resale in a manner prohibited by any Federal, State or local law or regulation. Unlawful resale or attempted resale is grounds for revocation and cancellation without compensation.  Tickets obtained from unauthorized sources may be lost, stolen, or counterfeit, and if so are void.  It is unlawful to reproduce this ticket in any form.

6. E-Cash

You may load cash to your Card by visiting the Program Website or by accessing the mobile site on your mobile device (“E-Cash”). E-Cash may be used to make purchases at select concession stands and vendors at the Ballpark.  Use of the Card for purchases of goods or services is subject to available E-Cash balances and to these Terms and ConditionsAll transaction history can be seen in your Account online.  You may load E-Cash in specific dollar amounts or schedule automated payments to be forwarded from your bank account once your E-cash account indicates a balance of less than $10. Visit the Site or call 202-675-NATS to check E-Cash balance.

7. Earn Reward Points

Points are earned in accordance with the Points Schedule set forth below.  The amount of Points earned by a Member depends upon the size and type of season plan(s) and/or suite(s) purchased by or licensed to the Member in connection with the 2013 regular season.  Members may also earn Points by purchasing additional seats or suites.

The Washington Nationals may, among other things: (a) increase or decrease the minimum number of plans required to participate in the Program, or increase or decrease the number of Points required to redeem a Red Carpet Reward (b) withdraw, limit, modify, or cancel any Red Carpet Reward; (c) limit the Red Carpet Rewards available; or (d) change Program benefits, conditions of participation, rules for earning, redeeming, retaining, or forfeiting Points, or rules governing the Program or the use of specific Red Carpet Rewards. Please check nationals.com/access frequently for updates to these Terms and Conditions.

8. Red Carpet Rewards and Points Redemption

Once activated, Members may start redeeming Points for 1) game seats (“Reward Seats”), suites (“Reward Suites”), and parking passes (“Reward Passes”) (“Reward Seats”, “Reward Suites”, and “Reward Passes” shall be referred to herein collectively as, “Game Rewards”); 2) Auction Items, as defined below; and 3) fan-based activities (“Experiences”).  Available at nationals.com/access, “Game Rewards”, “Auction Items” and “Experiences” shall be referred to herein collectively as “Red Carpet Rewards”.  All Red Carpet Rewards are subject to availability.

  • Game Rewards:  Points for Game Rewards may be redeemed in accordance with the Point Schedule.  Requests for Game Rewards may only be made for games scheduled to take place within 30 days of date of request.

Requests for Reward Seats and Reward Passes must be made a minimum of 3 business days prior to the game date. Requests must be submitted at nationals.com/access.  Within 24 hours of making a request for a Reward Seat or Reward Pass, an email will be sent to the email address on record for the Member, notifying him/her whether or not their request is approved or not approved. If approved, the email will contain a print-at-home link, and the Member must print each Reward Seat or Reward Pass, and bring it to the Ballpark on the relevant game date. Rewards Seats and Reward Passes will not be sent to Members in any other way. Members may change their email address on record in My Nationals Tickets by clicking the My Account tab. 

Requests for Reward Suites for a particular game must be made a minimum of 7 business days prior to game date. Requests must be submitted at nationals.com/access.  Within 3 business days of making a request for a Reward Suite, a Ticket Services Representative of the Washington Nationals will contact the requesting Member to notify them of the status of their request and, if approved, send the Member the contract that the Member must sign in order to receive a Reward Suite. A Member will not be permitted to redeem Points for a Reward Suite unless the Member signs the contract with the Washington Nationals containing terms acceptable to the Washington Nationals. Reward Suite seats will be mailed to the Member of record only. 

Game Rewards are available through the entire regular season, except for the blackout dates specified below, but the time to redeem Points for Game Rewards ends on August 31, 2013 at 11:59 PM ET. All requests must be submitted online by this date.  Points are redeemed for their full value only.  Game Rewards that have been received as part of the Program cannot be exchanged as part of the Season Ticket Exchange programs.

Blackout dates apply and are set by the Washington Nationals and are subject to change in its sole discretion. Currently the scheduled blackout days are: April 1 vs. Miami Marlins, April 13 vs. Atlanta Braves, May 27 vs. Baltimore Orioles, June 8 vs. Minnesota Twins, June 23 vs. Colorado Rockies, July 6 vs. San Diego Padres, July 20 vs. Los Angeles Dodgers, August 9 vs. Philadelphia Phillies, August 10 vs. Philadelphia Phillies, August 31 vs. New York Mets, September 21 vs. Miami Marlins.

  • Auctions:   From time to time, Members will have the opportunity to participate in online auctions (“Auctions”) and bid Points on select merchandise and activities (“Auction Items”).  Auctions will take place online only at the Program Website.  The availability and frequency of any Auctions are subject to the Washington Nationals’ sole discretion. The number of Points which must be redeemed for Auction Items will vary based on a number of factors, including but not limited to, the nature of the Auction Items, the number of other Members participating in the Auction, and the Auction Results.  Unless otherwise stated, by bidding Points on an Auction Item, you are committing to redeem those Points for that Auction Item.   If your bid is the winning bid or is otherwise accepted, the Points you bid will be automatically deducted from your online account.  Auction Items may not be returned or exchanged, and Points will not be re-applied to your account in you fail to accept receipt of Auction Items.  Detailed information for each Auction, including terms and restrictions, will be posted on the Program Website.   
  • Experiences:  From time to time, Members will have the opportunity to redeem Points for Experiences offered by the Washington Nationals.  The availability and frequency of any Experiences are subject to the Washington Nationals’ sole discretion.  The details of each Experience and the number of Points required will vary.  Detailed information for each Experience, including terms and restrictions, will be posted on the Program Website.

9. Points and Red Carpet Rewards Restrictions and Limitations

Points expire on August 31, 2013 at 11:59 PM ET and will not carry over to a subsequent season. No credit will be issued for any Points or Red Carpet Rewards not redeemed. Red Carpet Rewards are subject to change at any time without notice.  Points and Red Carpet Rewards may not be purchased with cash, credit card, or cash equivalents. Points and Red Carpet Rewards may not be resold or bartered by any means, electronic or otherwise. The Washington Nationals reserves the right to revoke and not honor any Points or Red Carpet Rewards that have been resold. Red Carpet Rewards cannot be upgraded (e.g. one cannot redeem Points for 2 field level seats and pay the difference to get 2 PNC Diamond Club seats).

Points for games that are rained out, postponed or cancelled for any reason may be used on the rescheduled game/makeup date only.  Points may not be redeemed for seats or parking for any Postseason games or “non-baseball events” held at the Ballpark.

Members who redeem their Points for a nightly suite rental agree to sign and be bound by the terms of any applicable contracts that coincide with renting a nightly suite.  With the exception only of a nightly suite rental, (with which the Member shall receive, in addition to the applicable amount of Game Rewards, four (4) parking passes located in “Garage C” or in an alternative lot associated with Nationals Park, as designated by the Washington Nationals), Game Rewards do not include parking; however, Members may redeem additional Points for Reward Passes in accordance with the Point Schedule.

With the exception only of the 2013 The Washington Nationals Buy 2 Get 2 Free Program (as described below), Points and Red Carpet Rewards cannot be combined with any other offer, including Season Ticket Exchange Programs or any individual plan offer.

Note: The Washington Nationals is not responsible for Red Carpet Rewards lost, misdirected, or delayed via mail or email, nor does it guarantee on-time delivery of Red Carpet Rewards. There are no guarantees that requested dates or the number of seats, parking passes, suites requested will be available. The Washington Nationals reserves the right, in its sole discretion, to limit the number of and type of Red Carpet Rewards made available for the 2013 season and each game.

Points and Red Carpet Rewards are not refundable, exchangeable, replaceable or transferable for cash or credit unless specifically permitted by these Red Carpet Rewards Program Terms and Conditions.   The Washington Nationals is not responsible for lost or stolen Red Carpet Rewards or Points, and no replacements will be provided.

10. Special Offers

From time to time, You may receive promotional offers (“Special Offers”) for discounts to select concession stands and team stores within the Ballpark.  The availability and frequency of any Special Offers are subject to the Washington Nationals’ sole discretion.  Your Membership does not guarantee access to Special Offers.  Special Offers for which you may be eligible may be forwarded either by email to your registered email account or by text messaging to your registered telephone number.  You must use your Card at the point of sale to redeem any Special Offers.  Special Offers must be valid at the time of redemption.  Special Offers are non-transferable and not redeemable for cash. Special Offers expire and will be made available for specific time periods before, during, or late in the game.  Please refer to Special Offer for full details, terms and restrictions.

11. Buy 2 Get 2 Free Program

Participants in the 2013 Washington Nationals Buy 2 Get 2 Free Program (“Buy 2 Get 2 Free Program”) may be eligible to participate in this 2013 Program if they meet the eligibility criteria set forth herein. Participation in the Buy 2 Get 2 Free Program is governed by a separate set of Buy 2 Get 2 Free Terms and Conditions available at nationals.com/2013. Only “Eligible Plans” (as defined in the Buy 2 Get 2 Free Terms and Conditions) shall be eligible to accrue Points under this 2013 Program. “Free Plans” (as defined in the Buy 2 Get 2 Free Terms and Conditions) shall not be eligible to accrue Points. By way of example only, if a Member pays in full for two Eligible Plans located in Section 137 prior to the first regular season home game of 2013, he/she shall receive two Free Plans under the Buy 2 Get 2 Free Program, but will only earn Points for the purchased Eligible Plan seats under this 2013 Program. No Points will be earned on any Free Plan seats.

12. Termination of Membership

The Washington Nationals reserves the right to audit any Member’s Account at any time. The Washington Nationals reserves the right, in its sole discretion, to discontinue participation for any Member who acts or is reasonably suspected of acting in any manner which is inconsistent with or violates these Terms and Conditions or any portion of the Program. The Washington Nationals also reserves the right to discontinue membership for any Member who acts in a manner inconsistent with local or federal laws, statutes or ordinances or if there are reasonable grounds for suspecting fraud, theft, or dishonesty in connection with the Program, as determined by the Washington Nationals in its sole discretion.Such discontinued membership may result in the loss, revocation, and cancellation of Points, Red Carpet Rewards, and all Program benefits and privileges.The Washington Nationals shall also have the right to take appropriate administrative and/or legal action, including, without limitation, criminal prosecution, as it deems necessary in its sole discretion.

13. Receipt of Information

Email is the Program’s primary method of providing service-related updates to Members.  Certain information relating to Red Carpet Rewards and to Special Offers, will only be communicated via email. Eligible Participants must provide a valid email address to enroll in the Program and are responsible for keeping their email information up-to-date. Email information can be updated in My Nationals Tickets by clicking the My Account tab. To ensure that all updates are received, we recommend that Eligible Participants add RedCarpet@nationals.com, feedback@mail.mlbamlists.com, feedback@lists.mlb.com, feedback@website.mlb.com  to their address book or “safe senders” list. The Washington Nationals is not responsible for any e-mail notifications that are bounced back or misdirected. Members may also elect to receive commercial emails and/or texts from MLB.com and nationals.com and can opt-out of receiving such commercial emails and texts at any time without affecting Points or Red Carpet Rewards; however, the Washington Nationals are not responsible for Red Carpet Rewards or other benefits that are not communicated because of a Member’s opt-out status, or for a Member’s not receiving a particular text message or email. By enrolling in the Program, one agrees to receive advertising, marketing materials and other communications from the Washington Nationals by mail. 

14. Disclaimer and Limitation of Liability

THE PROGRAM IS OFFERED “AS IS” AND “AS AVAILABLE.” THE WASHINGTON NATIONALS MAKES NO WARRANTIES EXPRESS OR IMPLIED WITH RESPECT TO THE PROGRAM AND THE WASHINGTON NATIONALS HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE PROGRAM, AND ANY PURCHASES OR RED CARPET REWARDS, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

YOU AGREE THAT THE WASHINGTON NATIONALS AND ITS AFFILIATES AND, SUBSIDIARIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY MEMBERS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE OR EXEMPLARY DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF A RED CARPET REWARD, OR PARTICIPATING IN THE PROGRAM OR RED CARPET REWARD-RELATED ACTIVITY.  THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY RED CARPET REWARD CANNOT BE AWARDED.  IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU FOR ANY DELAY IN OR FAILURE TO PERFORM DUE TO CAUSES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, ACT OF WAR, NATURAL DISASTER, WEATHER, TERRORISM, OR ANY ACT OR OMISSION OF A THIRD PARTY. THIS SECTION WILL SURVIVE TERMINATION OF MEMBER’S PARTICIPATION IN THE RED CARPET REWARDS PROGRAM.

15. Disputes/Choice of Law

This Program shall be governed by the internal laws of the District of Columbia, without regard to its conflicts of laws, rules or policies. The Washington Nationals and Member agree that any dispute, claim or controversy arising from or relating to this agreement or participation in the Program shall be resolved by binding arbitration conducted in the District of Columbia. The parties acknowledge and agree that each has chosen arbitration rather than litigation to resolve any such dispute, claim or controversy.The parties understand that a judgment on any arbitral award may be entered in any court having jurisdiction.No arbitration under this agreement shall be consolidated with any other arbitration, and the earning and redeeming of Points and Red Carpet Rewards are subject to all applicable local laws and regulations. Points and Red Carpet Rewards are offered in good faith, however they may not be available if prohibited or restricted by applicable law or regulation in the United States of America. If any part of these Terms and Conditions is held to be unlawful or unenforceable, that part will be deemed deleted from these Terms and Conditions in such jurisdiction and the remaining provisions will remain in force. All disputes which cannot be resolved between the parties, and causes of action arising out of or connected with the Program shall be resolved individually, without resort to any form of class action.

16. Miscellaneous

  1. The Program is subject to all applicable laws and regulations and is void where prohibited by law.
  2. Unless otherwise stated herein, Points may not be assigned, sold or otherwise transferred by the Member, by operation of law or otherwise.
  3. Except as otherwise provided herein, the receipt and redemption of Points and Red Carpet Rewards cannot be combined with any other offer or discount.  Points have no cash value and may not be redeemed for cash.
  4. Members are solely responsible for any tax liability, including the determination thereof, which may arise result from earning and redeeming Points and from using and receiving Red Carpet Rewards.
  5. By participating in the Program, Members consent to and authorize the Washington Nationals to collect information about the Member in accordance with the terms of its Privacy Policy, which can be accessed by visiting nationals.com
  6. All questions or disputes regarding eligibility will be resolved by the Washington Nationals in its sole discretion. The Washington Nationals has the sole discretion to interpret and apply the Program Terms and Conditions.  The Washington Nationals’ interpretations of and decisions regarding these Terms and Conditions shall be final and binding. 
  7. Accumulation of Points are not Member’s property and may be revoked, cancelled, limited or modified at any time, even though such action may affect the Member’s right to redeem previously accumulated Points.
  8. Message and data rates may apply for text messaging and other services available via your mobile device. Check with your mobile service provider for details on specific fees and charges that may apply to you.
  9. These Program Terms and Conditions constitute the entire understanding between the Washington Nationals and Member with respect to the Program, and supersede any and all prior communications, whether written or oral.
  10. Each Member is responsible for remaining knowledgeable as to the Program Terms and Conditions and as to the number of Points in his or her account. The Washington Nationals may attempt, but is not required, to send correspondence to active Members to advise them of matters of interest, including notification of Program changes. The Washington Nationals will not be liable for any failure to do so and will not be responsible for incorrect or inaccurate transcription of Member contact information, for problems related to any of the equipment or programming associated with or utilized by the Member, for any human error, for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access any Web site or on-line service, for any other technical or non-technical error or malfunction, for lost, late, stolen, illegible, incomplete, garbled, misdirected, mutilated or postage due mail or other mail or e-mail for whatever reason.
  11. The Washington Nationals’ waiver of any breach of these Program Terms and Conditions shall not constitute a waiver of any other prior or subsequent breach of these Terms and Conditions. Its failure to insist upon strict compliance with these Terms and Conditions shall not be deemed a waiver of any rights or remedies that it may have against that Member or any other participant in the Program.
  12. Members and their guests shall at all times maintain proper decorum while attending games at the Ballpark and will abide by all applicable governmental laws, ordinances, orders, directions, rules and regulations, as well as all rules and regulations as are adopted and revised from time to time by the Washington Nationals or any of its affiliates.  The Washington Nationals reserves the right to exclude or eject from the Ballpark any and all unruly, rowdy or disruptive persons or person who otherwise violate the Guest Conduct Policy without liability and the applicable Member shall be fully responsible for any damages or expenses, direct or indirect, incurred by The Washington Nationals and its affiliates as a result of such disruptive behavior and/or ejection.
